When registering to be User of < http://bidsnest.co.uk/> (afterwards referred to as “Auction Environment”) or making one-time SMS offer in Auction Environment, one has to accept all terms and conditions given below and enter into contract with Bidsnest.co.uk(afterwards referred to as “Auction Arranger”) on all terms and conditions given below.
*1.* Auction Arranger:

*2.* User: A person, who uses
Auction Environment.
*3.* Products offered to User: User can purchase goods or services in Auction Environment in an auction (afterwards referred to as “Products”). Under the term Products all other possibilities and solutions offered by Auction Environment and used by Client are also meant.
*4.* User can use Auction Environment Products by registering itself as Auction Environment user and opening personal user account or by some other measure made available by Auction Arranger. The contract between Auction Arranger and User is considered to be signed from the moment User has registered itself as Auction Environment user or started to use Products in some other way.
*5.* User will register itself as Auction Environment user by filling in and confirming registration form. When becoming Auction Environment user, each User will choose itself personal username and password.
*6.* Auction Arranger is not responsible for User’s illegal activities.
*7*. User will be responsible for all tax liabilities that result the usage of Auction Environment Products, when it is not stated otherwise in law.
*8. User is not allowed in any cases to damage, disturb and violate Auction Environment and its normal functioning. User is not allowed to distribute spam letters, chain letters, viruses and other technology, compose so-called pyramid schemes and practice other activities which might cause damage to Auction Arranger or Auction Environment. In case User employs scripts when using Products, Auction Arranger has unilateral right to cancel all contracts signed with User, including closing User’s account in Auction Environment.
*9.* User is not allowed to collect information about other Auction Environment users (including e-mail addresses) without the permission of those Users.
*10.* When using Auction Environment Products, User will present only true and correct information.
*11.* Auction Arranger is not the agent, broker, representative, commissioner etc of User.
*12.* When registering to be User of Auction Environment and using Products of Auction Environment, User gives permission to Auction Arranger to process data given by User according to laws and conditions effective in the United Kingdom and Northern Ireland. User has the right to withdraw from the permission given and require Auction Arranger to stop processing its data. The withdrawal from the permission will have no retrospective effect.
*13.* Copyright of Auction Environment and its content is owned by Auction Arranger.
*14.* In case of violation of copyright described in Terms and Conditions Auction Arranger has the right to use measures of legal protection, including the right to demand termination of copyright violation and compensation of any kind of loss.
*15. Only legally capable persons at least 18 years old can participate in auctions. Employees of Auction Arranger and Auction Arranger itself are not allowed to participate in auctions. User is not allowed to register and use more than one account.
*16.* User has the right to participate in auctions of Auction Environment mentioned in point 2 by bidding, using for that purpose internet banks of credit institutions through its User account in Auction Environment (afterwards mentioned as Bank Link Service) or sending SMS to short number (afterwards mentioned as SMS Service).
*17.* SMS Service can be used by contractual clients and owners of call cards of mobile communication operators listed in Auction Environment. Price of one SMS message is given in Auction Environment. Price of sent SMS messages will not be returned, except on conditions listed in Terms and Conditions.
*19.* Bank Link Service can be used by registered Users of Auction Environment, by buying credit through internet bank according to the price list published in Auction Environment.
*20.* Auctions start every day at 11.00 AM and stop every night at 00.00 AM. Bids made between 00.00 AM and 11.00 AM will not be taken into account. When the auction Product has marking "24", then the auction will not stop and will last as long as bids will be made.
*21.* Auction Arranger has the right to stop, close or cancel auction in case Auction Arranger’s computer system is damaged, interrupted or some system fault will appear, which could influence the course and result of auction. In case a specific auction cannot be restored, Users will be returned all fees paid for bidding in the specific auction.
*22. Agreements between Users to purchase Products in auction are not allowed, when those agreements affect the possibilities of other Users to purchase Products. In case Auction Arranger has justified doubt, that Users participate in an auction using agreement mentioned in previous sentence, then Auction Arranger has the right to eliminate those Users from auction, whereas no fees for making bids will be returned in that case.
*23.* Auction Arranger is not responsible for computer system faults that occur on circumstances independent from Auction Arranger.
*24.* Auction Arranger is not responsible for SMS messages sent by User, that will not arrive at the right time.
*25.* Auction Arranger is not responsible for User’s internet connection or mistakes resulting from User’s computer.
*26.* Start price of every auction Product is 0 (zero) GBP. Each bid increases the price of Product by 0,01 (zero point zero one) GBP. Bid making time (afterwards referred to as Bid Time) will be shown in a special box beside auction Product. After each bid the Bid Time will start from the beginning. Auction will end, when Bid Time has ended and no one has made a new offer during Bid Time. After auction has ended, only those bids will be taken into account, which have reached the Auction Arranger by the end of Bid Time. When Bid Time left reaches 0 (zero), a control time is activated, during which system takes into account late SMS messages. Control time has a length of 5 (five) seconds. Bids made during control time are not taken into account. Best offer is made by the person, who is not followed by new offer during the Bid Time. The name of person recognized as best bidder (winner of auction) will be shown beside auction Product in special box. After auction has finished, an auction Product sales contract between Auction Arranger and best bidder (afterwards referred to as Buyer) is considered to be signed.
*27.* In case of acquiring the buying possibility at auction, the Buyer will pay auction Product final price according to invoice sent by Auction Arranger. In case invoice will not be paid by the time given on invoice, the buying possibility will be cancelled and best bidder will lose the right to purchase auction Product at winning price, also the auction bid fees will not be returned. Buyer must pay invoice personally and with bank transfer. Third party is not allowed to pay the invoice. In case invoice is paid by third party, Auction Arranger has the right to close User’s accounts, not to return credit on Accounts and not to deliver Products won with User’s accounts.
*28.* In one month one User can obtain in maximum 15 (fifteen) buying possibilities from Auction Arranger.
*29.* Auction Arranger will deliver the auction Product to Buyer the latest 19 (nineteen) days after Buyer has paid the invoice. The auction Product will be delivered on the address given by Buyer. Auction Arranger will cover delivery costs in the United Kingdom and Northern Ireland. In case auction Product must be sent outside the United Kingdom and Northern Ireland, Buyer will cover delivery costs.
*30.* In case auction Product has deficiencies, Buyer must notify of them to Auction Arranger without delay. Buyer has the right to return auction Product in 14 (fourteen) days starting from the day Buyer got it. Auction Product returned must be without damage, in original package and unused. In case of returning auction Product, Auction Arranger will return Buyer the auction Product price without delay after checking the auction Product, but no later than in 2 (two) months. Bidding costs and auction Product return costs will not be returned by Auction Arranger.
*31.* Auction Arranger is responsible for auction Product deficiencies, which appear during the guarantee period given by producer, importer or seller starting from the auction Product delivery date to Buyer.
*32.* Auction Arranger is not responsible for deficiencies that have emerged from:
*32.1* Not purposeful usage of auction Products;
*32.2* Normal physical wearing of auction Product during normal purposeful usage;
*32.3* Auction Product deterioration or damage, what risk is covered by Buyer.
*33.* In case of discovering deficiencies of auction Product or auction Product not corresponding to requirements Buyer will send message the latest in 2 (two) weeks after discovering deficiency of auction Product or Product not corresponding to requirements on World Investments Group Ltd e-mail address < admin@bidsnest.co.uk> In case of not following the date mentioned in current point without reasonable excuse Buyer will lose the possibility to use the option of the deficiency of auction Product or Product not corresponding to requirements.
*37.* In case of Product deficiency or Product not meeting requirements, Auction Arranger has the right to replace that Product with a one not deficient or meeting requirements, but also to repair that Product. For Product replaced during guarantee time a new guarantee time will be given in the same length as for initial Product. In case of Product repair during guarantee time, guarantee time will increase by the time the Product was repaired.
*38.* In addition to rights proceeding from guarantee, Buyer has other rights proceeding from law.
*39.* Auction Arranger has the unilateral right to change and amend terms and conditions, publishing notice about it and changed and/or amended terms and conditions in Auction Environment. Changes and/or amendments of terms and conditions will come into force from the moment of their publishing in Auction Environment.
*40.* User has the right to end using Products and close User account. All liabilities that have emerged before User stops using Products and closes User account are valid until they are fulfilled properly.
*41.* In addition to Terms and Conditions and United Kingdom and Northern Ireland legislation the relationship between User and Auction Arranger is regulated by: Auction Environment price list of Products, terms specifying Products in Auction Environment and good practice.
*42.* Disputes rising from Auction Environment usage will be solved through negotiations. In case of failure of negotiations disputes will be solved in court. Disputes are considered failed, when dispute parties will not reach a settlement satisfying both parties in 60 (sixty) calendar days from the start of the dispute.
